Is It Illegal to Use a Radar Detector in Virginia? What the Law Says

Yes. Virginia Code § 46.2-1079 makes it unlawful to operate a vehicle on the Commonwealth’s highways when it is equipped with a device that detects or interferes with speed-measuring equipment, subject to a narrow exception.

Is It Illegal to Use a Radar Detector in Virginia? What the Law Says
01

What Virginia Code § 46.2-1079 says

The statute says it is unlawful to operate a motor vehicle on Virginia highways when equipped with a device or mechanism, passive or active, to detect or purposefully interfere with or diminish the measurement capabilities of law-enforcement speed-measuring equipment. It also prohibits using such a device on a vehicle on those highways.

02

Does the prohibition cover an ordinary radar detector?

The text covers devices designed to detect radar, laser or other equipment used by law enforcement to measure vehicle speed. The statute’s wording is broad; do not assume a detector is permitted because it is passive, switched off or marketed as a warning device.

03

The exception stated in the law

Section 46.2-1079 excludes a receiver of radio waves used for lawful purposes to receive a signal from a frequency lawfully licensed by a state or federal agency. The same section separately provides an exception when a prohibited device has no power source and is not readily accessible to the driver or a passenger at the time of the alleged offense.

04

What the statute says about penalties and points

The section says no demerit points are awarded for a violation. It does not make detector use lawful, and questions about a specific charge or other consequences require checking the current law and getting legal advice.

05

If you drive across state lines

Rules vary by jurisdiction, and a device allowed elsewhere may still be prohibited in Virginia. Check the law for every state on your route before carrying or operating a detector there.

Our methodology

We reviewed the current text of the Virginia Code provision linked below and summarized its stated scope and exceptions. We have not physically tested radar detectors; this page is general legal information, not advice for an individual case.

Common questions

Questions before you buy

Is it illegal to use a radar detector in Virginia?

Yes. Virginia Code § 46.2-1079 prohibits operating a motor vehicle on the Commonwealth’s highways when equipped with a device to detect or interfere with law-enforcement speed-measuring equipment, subject to the statute’s exceptions.

Can I keep a radar detector in my car if it is turned off?

The statute addresses whether a vehicle is equipped with a prohibited device and says it need not be operative. It states an exception if the device has no power source and is not readily accessible to the driver or a passenger at the time of the alleged offense.

Does Virginia award points for a radar detector violation?

Section 46.2-1079 states that no demerit points are awarded for violations of that section. That does not remove the prohibition itself.

Does Virginia's rule apply only while driving on public highways?

The section describes operating a motor vehicle on the highways of the Commonwealth and use on such a vehicle on those highways. For questions about a particular location or situation, consult the current statute or an attorney.

Are radar detectors legal in other states?

Rules differ by state and can change. Check the current law in each jurisdiction where you plan to drive rather than relying on Virginia’s rule elsewhere.
